Member districts that provide or arrange compensated pupil transportation shall comply with all applicable requirements of Education Code sections 39875–39882 and related provisions.
Driver Requirements
Member districts shall ensure that all compensated drivers meet applicable statutory requirements, including, as applicable:
- Criminal background clearance, fingerprinting, and TB risk assessment
- DMV pull-notice participation and satisfactory driving record
- Medical fitness and recertification
- Drug and alcohol testing
- Required safety and first aid training
- Duty-hour limitations and required documentation
Vehicle Requirements
Vehicles used for compensated pupil transportation shall meet all applicable statutory requirements, including required inspections, safety equipment, and vehicle type or capacity limitations.
Contracted Transportation
When using a private entity to provide compensated pupil transportation, member districts shall require:
- Written attestation of contractor compliance with Education Code requirements
- Maintenance of required driver qualification documentation
- Reasonable access to compliance documentation, as permitted by law
Exceptions or exemptions shall be applied only when expressly permitted by Education Code section 39875 and related provisions.
Member districts shall maintain documentation sufficient to demonstrate compliance and shall take corrective action when noncompliance is identified. Failure to comply may result in the district being responsible for the full member retained limit, should a claim occur.
